The California Occupation Safety and Health Standards Board (Cal/OSHA) intend to add a section (number 5199) controlling aerosol transmissible disease hazards. Patients and employees in health care and other high-risk environments need protection from new and emerging infectious disease threats, such as Severe Acute Respiratory Syndrome (SARS), drug resistant staph infections such as methicillan-resistant Staphylococcus aurous (MRSA) as well as other potentially emerging threats such as pandemic influenza strains, and virulent derivative strains of tuberculosis (TB) and pertussis.

The effect of the amendment will require certain California employers to implement infection control measures in order to protect employees from aerosol transmissible threats. Specifically, the purpose of this standard is to identify to the regulated public those infection control measures which are necessary to protect patients and employees, and to provide Cal/OSHA with the authority to enforce these protective measures in accordance with its legislative mandate.

1. Hospitals
2. Skilled nursing facilities
3. Clinics, medical offices and other outpatient medical facilities
4. Facilities where high hazard procedures are performed
5. Home health care
6. Public health services
7. Long term health care facilities and hospices
8. Medical outreach services
9. Paramedic and emergency medical services including those services when provided by firefighters and other emergency responders
